cori regulation

The Massachusetts Criminal Offender Records Information (CORI) law has been overhauled and includes an important employer provision. Under the new language, employers are prohibited from asking about criminal charges, arrests, or incarcerations on their initial written application. Employers are advised to remove questions regarding felony and misdemeanor convictions in order to prevent any unwanted liability.

The new law preserves employer access to criminal records and freedom to make hiring decisions based on individual's criminal background. This information must be disclosed to the applicant and take place after the initial written application.

The Massachusetts Commission Against Discrimination (MCAD) Fact Sheet outlines employer procedures under the new law. This also includes a FAQ section.
